Injured Patron Sues Eataly After Falling on a Piece of Prosciutto

Even fancy food establishments with high prices sometimes fail to use proper care to clean up something that has spilled on the floor. Serious slip and fall injuries occur at fancy restaurants and gourmet markets just like they do at greasy spoons. One woman learned this lesson the hard way when she slipped on a piece of prosciutto at a high-profile eatery linked to a celebrity chef.

Located in New York and other cities, Eataly combines restaurants and upscale Italian food markets. One owner is Lidia Bastianich, who is famous for her cooking books and television shows. Now, a patron at the Boston location is suing Eataly for the damages she incurred after breaking her ankle there.

Spilled food and drinks are a leading cause of slip and fall accidents on premises that are open to the public. Using the example from this case, prosciutto is very thinly cut and has a smooth texture. This makes it particularly hazardous if someone steps on it without seeing it. Other foods and beverages that lead to a high number of premises liability claims including the following:

  • French fries and other greasy foods
  • Ice cream, particularly when it has melted
  • Water, because it is clear
  • Mashed potatoes and other mushy foods
  • Sugary drinks that can leave a sticky residue even after the spill dries

Restaurants, grocery stores and even homeowners have a legal obligation to maintain a safe environment for their invited guests. Part of this duty includes cleaning up spills and hazards promptly or taking reasonable steps to warn visitors about them. When someone gets hurt because a property owner or manager failed to fulfill their duty, legal relief is warranted. Specific damages can include compensation for medical expenses, lost income and the pain and suffering experienced by the victim.

If you slip and fall due to spilled food or some other hazard, seek medical attention immediately, no matter how minor you think your injuries are. As long as you are physically able, take photos of the scene and write down everything you remember about the incident. Getting the contact information of potential witnesses could also strengthen your slip and fall claim.
